Additional persons, besides yourself, whom you authorize on your account with us (billing, update requests, and passwords). Please enter their first and last name or they will not be authorized.

Definition
In this contract, "client" shall mean the person who completes and signs this contract. No other person is authorized to access or discuss the client's account with Handmade Designs LLC, or request work, unless Handmade Designs LLC has received written authorization from the client for this additional person to have account access. The client who signs this form is fully responsible for all account charges incurred by anyone whom the client authorizes on the account.
New Project Development Process
- We need the following items before we can begin work on the client's project. Once these are received, we will begin development.
- New Client Registration Form (www.handmadedesigns.com/signup.php)
- Non-refundable deposit of 50% of the total project cost
- All information needed for the project (such as server access, design specifications, text, and images)
- After we receive the above items, we will create the project according to the written proposal we provided to the client.
- When we have finished the project, the client will review the project and provide, in one single written or emailed document, a list of changes to be made to the draft. The client shall provide this list within 14 calendar days after we send the project to the client.
- We will implement the changes on the client's written or emailed list of changes, then invoice for the remaining balance.
- The invoice payment is due in 14 calendar days. After payment is received, we will provide the project files to the client.
The client may request additional changes to the project after submitting the first list of changes. They will be charged $60/hour for these additional changes.
If the client provides no list of changes during the 14-day preview period, we will invoice for the project balance at the end of the preview period. The invoice payment is due in 14 calendar days.
The client is responsible for providing complete design specifications for the project, including layout and colors. If such specifications are not provided, or are incomplete, we will make a good faith attempt to create a good design layout for the project, but cannot guarantee that such a design will meet the client's desires.
Rates and Charges
Any feature or specification not explicitly included in a written proposal provided by Handmade Designs LLC is not included in the price quoted in the proposal. If the client requests a feature or specification to be added to their project (whether before, during or after the preview period), this will be at additional cost to the client.
We provide free time and cost estimates, free proposals, a one-hour free consultation for new clients, and up to two hours per year of free tech support for hosting clients. All other services (such as website updates, meetings, computer help, code tutoring, etc.) are billable at our current hourly rates.
The client who signs this form is fully responsible for all account charges incurred by anyone whom the client authorizes on the account.
Guarantees and Disclaimers
For projects we fully create, we take responsibility for:
- correcting spelling and punctuation errors,
- validating HTML to W3 standards,
- testing website performance and appearance on mainstream browsers, and
- ensuring all hyperlinks and navigation elements function properly.
Should the client, or anyone else not affiliated with Handmade Designs LLC, make any changes to the project or to the server on which the project resides, or upload any files to the server where the project resides, we shall disclaim all responsibility for any problems with the appearance and functionality of the project, including typos, HTML validation errors, php errors, hyperlinks, etc. Time spent addressing these and any other website issues will be billed at our current hourly rate.
The client is responsible for notifying us via email if the client makes any change to the website code. If the client changes website code without informing us, we may overwrite or correct those changes, intentionally or inadvertently, and this may cause extra expense to the client.
The client may upload the project to the host server of their choice. We are not responsible for the functionality, reliability, or features of the server, or for damage or loss caused by server problems. Support for websites not hosted on our server is billed at our current hourly rate.
Ownership and Copyrights
The client shall own exclusively all materials developed by Handmade Designs LLC for that client.
On certain projects, we may utilize code, images, or other products previously created or obtained by Handmade Designs LLC. Any such products are, and shall remain, the exclusive property of Handmade Designs LLC or their owner, although the client shall have license to display and utilize such items solely on the project we create for them. Handmade Designs LLC retains full ownership of products that it owns, and the exclusive right to copy, implement, distribute, modify, and sell them.
The client guarantees that the client has full ownership or right to use any text, images, etc. that the client provides for the project. We are not responsible for any liability arising from the use of copyrighted or trademarked items on the client's website.
We reserve the right to display the client's name and a screenshot of the project on our website.
Our Hosting Service
Our hosting accounts include an outgoing (SMTP) mail server. We do not guarantee that this server is accessible by the client's computer. For example, the client's internet service provider, anti-virus software, or computer settings may block usage of this server. In such cases, we suggest using the ISP's outgoing mail server.
Our hosting accounts include third-party software, such as webmail and message board programs. Such software is developed and supported by third parties independent of Handmade Designs LLC, and we make no guarantees about the functionality or reliability of such software. We do not provide free tech support for such software.
Handmade Designs LLC is not responsible for loss of income, loss of data, or any other damages caused by any server, email, or website problems, such as server downtime or failure to backup files.
We reserve the right to shut down any hosting account with no advance notice if there is pornography, viruses, or illegal material on the account.
Client Accounts
Monies paid to Handmade Designs LLC for project deposits, invoices, hosting accounts, and domain names are not refundable.
For hourly work (such as website updates) we provide an itemized invoice on the last business day of every month. The invoice must be paid within 14 days. Past due balances accrue finance charges at the rate of 2% per month until the balance is paid in full. Accounts are sent to a collections agent once they are 60 days past due.
If a payment is bounced, refused, canceled, or charged back for any reason, a $25 charge will be added to the client's account.
Contract Validity
In accordance with the Electronic Signatures in Global and International Commerce Act of 2000, electronic contracts and signatures are as valid as paper contracts in all states, regardless of where the parties live or where the contract is executed. You have the right to request a paper contract from us. Regardless of whether you make such a request, your electronic signature on this registration form shall remain legally valid and binding.
Handmade Designs LLC reserves the right to amend this contract at any time. Such updates will be available at www.handmadedesigns.com.
